Workers’ Compensation Insurance in Florida

Coverage for your team if someone gets hurt on the job, including through the FWCJUA when the standard market turns you down.

Workers’ compensation pays the medical bills and part of the lost wages when an employee is hurt or gets sick because of their work. Florida requires it for most employers, and construction businesses need it from the very first employee. If the standard market has already turned you down, we can place coverage through the FWCJUA, the state program built for businesses that cannot get workers’ compensation anywhere else.

Coverage We Offer

  • Medical Treatment
  • Lost Wage Benefits
  • Rehabilitation Costs
  • Death Benefits
  • Employer’s Liability
  • FWCJUA Placement

Common Workers’ Compensation Questions

It depends on your industry. Construction businesses need coverage with one or more employees, non-construction businesses at four or more, and agricultural employers at six regular or twelve seasonal workers. Corporate officers and LLC members count toward that total unless they hold a valid exemption.

The Florida Workers’ Compensation Joint Underwriting Association provides coverage for businesses that cannot obtain it through the standard market. It lets you meet Florida’s requirement and protects your employees if someone is injured. You generally need documented declinations from at least two insurers to qualify.

Officers and LLC members can file a Notice of Election to be Exempt with the state. In construction, no more than three can be exempt and each must own at least 10 percent. Keep in mind an exemption removes that person from coverage rather than covering them.

If a subcontractor does not carry their own workers’ compensation or hold a valid exemption, their payroll can be added to your policy at audit and billed to you. Collect a certificate of insurance from every sub before they start work.
